AUTOMOBILE/PEDESTRIAN NEGLIGENCE SETTLEMENT:    $1,350,000.00

After fighting for what was right for her client in a personal injury case involving a horrific auto accident, Ms. Wendy Schiller-Nichols was able reach a 1.35 million-dollar settlement with the Defendants.   Ms. Schiller-Nichols sued three defendants, the drunk driver, the employer (under a legal principle known as respondeat superior), and an action against the bar that served the drunk driver (known as a “dram shop” action). The driver of the vehicle had at least a .12 blood alcohol level at the time of the accident: 11:30 a.m..

The Nichols Law Firm’s client was a 47 year old man, who was working at a road construction site when he was hit by the car driven by the drunk driver. He suffered multiple injuries including a traumatic brain injury that caused permanent cognitive injuries and impairments and multiple pelvic fractures requiring surgery (ORIF of right acetabulum and iliosacral screw fixation to the left sacroiliac joint).

On May 3, 2006, at approximately 11:14 a.m., The Nichols Law Firm’s client was working in an approved construction zone in Muskegon, MI.  Defendant-driver, while intoxicated, (and at the time employed and working on the job), was driving the vehicle owned by a co-worker. The driver lost control of his motor vehicle and collided with The Nichols Law Firm's client.  The Nichols Law Firm's client was unconscious at the scene.  He was lucky to survive and remained hospitalized for approximately 41 days.  Following discharge, he required 24/7 attendant care for 69 days, reduced to 6 hours then to 4 hours.   As of the date of settlement, he had not returned to his previous job in road construction.

“This car accident case was so much more than just a motor vehicle accident” said attorney Wendy Schiller-Nichols.  “This was an accident that should NEVER have happened. After I met our client and his wife for the first time I knew that this family needed someone to fight for them … and that’s what I did”.
