An Ontario, Canada man has his life back despite an OWI-OUIL-DUI charge in East Lansing that would have stained him as a drunk driver and complicated his efforts to help people in Michigan and elsewhere. “The client needed a non-dui result. We could not negotiate it because the prosecutor apparently felt the facts were too bad. Therefore, we had no reason to do anything but go to trial,” said Nichols, an East Lansing attorney practicing for nearly 13 years. The man buys foreclosed homes, rehabilitates them, then leases them back to displaced families with options to purchase.
A jury in East Lansing found the man not guilty on Thursday March 22d after a 1 day trial and an hour and a half of deliberations. Nichols said: “critical to our success was that we did not oversell anything to the jury but we merely tried to present the full picture to them about what happened in those early morning hours while he was trying to find his hotel near Michigan State University’s campus.” Nichols called on expert witness, Ronald Henson, PhD., of Peoria, Illinois to educate the jurors on field sobriety testing and breath testing. Nichols added: “Dr. Henson keeps his testimony within a reasonable degree of scientific certainty and that is vital to having credibility with a jury,” added Nichols.
