CALHOUN COUNTY DRUNK DRIVING CHARGE LEADS TO A DISMISSAL FOR BATTLE CREEK DUI LAWYER WENDY SCHILLER-NICHOLS

A traffic stop in Marshall for weaving and touching the lane twice didn't seem quite right to DUI attorney Wendy Schiller-Nichols. So she obtained the video and saw it for herself: the accused's driving did not appear to support reasonable suspicion for a traffic stop for suspicion of DUI.

Wendy's motion to suppress led to a careless driving for her client who's blood was a .09. Client was stopped for swerving and crossing the fog line twice. Wmsn filed a motion to suppress based in lack of probable cause to stop her client. Prior to hearing the motion, the client was offered reckless, which she refused. With further persuasion, prosecutor offered careless driving, which client accepted. Prior to filing the motion to suppress with the court, thebest offer from the prosecutor was impaired driving. Careless driving is a civil infraction and 3 points.
