Michigan drunk driving attorney Mike Nichols is at it again: he is taking the government to task in a case in which the claims made by the police and the Michigan State Police lab may not be supported by the evidence.
"I cannot talk about the specifics of the case because we just picked a jury and we are heading for trial," Nichols said shortly after leaving court recently. He added: "suffice to say, it has been very difficult to get supporting data from the blood lab for their figures and I am looking forward to presenting this case to the jury." Nichols is seen here leaving court after jury selection. Many district courts pick juries on one date then have the parties and the jury come back at a later date for trial.
Mike Nichols is the author of the OWI Handbook by West Publishing, which is scheduled for an update in fall, 2012. He worked doggedly on the update throughout the first 6 months of the year. "The goal is to help other lawyers learn what Mothers Against Drunk Driving does not want you to know - that sometimes the person is innocent and the police officer made a mistake when they thought the person guilty of violating the drunk driving laws." He added, "we of course do not condone drunk driving but we also have a sworn duty to protect our clients."
