REGISTERED CAREGIVERS UNDER THE MICHIGAN MEDICAL MARIJUANA ACT (MMMA) NOT BEING PROTECTED

 A citizen of Big Rapids, Michigan, was sentenced in US District Court for conspiracy and manufacturing marihuana.  The defendant, John Marcinkewciz II, faces at least 5 years in prison for his actions.  Mr. Marcinkewciz was originally charged under state law but the prosecutor dismissed the case and federal charges were filed.  Mr. Marcinkewciz, who was a registered caregiver under the Michigan medical marihuana act, (MMMA) believed his actions were within the protections provided by the voters when they enacted the MMMA in 2008.

Despite the protections provided by the voters, Mr. Marcinkewciz was not protected under federal law.  This is because state medical marihuana laws do not supersede federal laws which criminalize marihuana.
