East Lansing OWI OUIL OUID Attorney Mike Nichols is working with other attorneys to lead a challenge to some of the issues with the breath alcohol device known as the Datamaster DMT that has been put in place in some counties throughout Michigan. Nichols says “The head of the alcohol enforcement unit says that he limited the distribution to the Lansing area so that he would not have far to drive to testify about them in a so-called Daubert Hearing.” We are happy to accommodate that request. Nichols is talking about Sergeant Perry Curtis of MSP, who has over three years tried to implement the DMT’s along with some other drugged driving programs.
Nichols is challenging some of the accuracy check methods used by the State of Michigan, as well as some other issues with the DMT, as well as some manufacturing quirks of the instrument. He adds, “part of the issue is that those who are charged with zero tolerance or “under 21 BAC” have an instrument that is not calibrated, or even accuracy tested at the concentrations that are relevant to their case. The same goes with individuals charged with ‘superdrunk’.
