Shortly after midnight the United States House of Representatives voted to use the power of the purse to protect medical marijuana patients. The measure passed because a group of republicans supported withholding federal funds from the justice department to pursue prosecuting and raiding legitimate medical marijuana patients and their property. Michigan attorney Mike Nichols, a leader in defending those charged with driving while under the influence of drugs, was surprised at some of those who voted for the bill: “the supporters of the measure include Fred Upton, a republican from conservative west Michigan. This is perhaps a libertarian push against government or a sign of the times about views toward the war on drugs,” Nichols says. Nichols is defending 1 of 37 people currently charged in a federal indictment for profiting from the sale of medical marijuana by abusing the Michigan medical marijuana act.”
Medical marijuana attorney and advocate Josh Covert is hopeful that the bill will lead at least to a more relaxed view of how medical marijuana patients are treated. Covert says “defending those charged with violating the drug laws at both the state and federal level is my passion,” Covert says.

The measure is House Resolution 4660. It must still go to the U.S. Senate for approval.
