East Lansing, Lansing and Meridian Township OWI or Drunk Driving Charges are Not Your Father's "DUI" Anymore

By Michael Nichols
Categories: Michael J. Nichols

Summer of 2018 is upon us and the latest trend by law enforcement is to arrest people for OWI (Operating While Intoxicated) even if they have not a drop of alcohol on board. The reason for this trend? A push by law enforcement to arrest people for drugs - and not just the illegal category. East Lansing criminal attorney Mike Nichols is the author of the preeminent practice guide for Michigan lawyers on drunk driving. He says "law enforcement is making this push because alcohol driving arrests are going down."

There are 2 types of drugged driving cases - illegal drugs which cannot be prescribed like cocaine, heroin and marijuana (unless you are a patient) and legal drugs. Nichols says "2 things are important, there is no such thing as a sobriety test that has been validated for drugs and impairment and there is no such thing as a blood level that is correlated to impairment."

Nichols is speaking to the Michigan State Bar Criminal Law this summer as well as the Michigan Judges Association.
