Marijuana possession charges against a Colorado man were dismissed thanks to dogged legal representation and advocacy by criminal law expert and law professor Mike Nichols of Lansing. “The prosecuting attorney proved to be very reasonable and fair once we finally had an opportunity to discuss with the relevant investigating officers the facts of the client’s cooperation. We confirmed on the morning of jury selection that the client held up his part of the bargain.”
The client was arrested over two years ago with a small amount of marijuana. The client had entered into an agreement that would lead ultimately to the outright dismissal of the case. Once the prosecuting attorney was finally able to confirm through one of the investigating officers that the client did hold up his end of the bargain, the prosecutor agreed to dismiss the case.
“This was a situation where the prosecutor already made what would have been a reasonable offer in most circumstances,” said Nichols. “However, it was important to me that this 22 year old young man realize the benefits of the agreement that he entered into, with the expectation that the other side would hold up their end of the bargain, just as he had. I wanted him to experience that life lesson in a positive way. That’s why I worked as hard as I did to track down the investigating officer before we selected the jury and prevailed upon the prosecuting official. The prosecutor then very appropriately decided that the dismissal was the right thing to do.” The client can now start his new business in Colorado without having to worry about the case, the charges, or any probation terms hanging over his head.
