CLIENT'S MINOR IN POSSESSION DISMISSED

Attorney Wendy Schiller-Nichols obtained a dismissal of her client’s Minor in Possession (MIP) charge.  The officer did not ask the client for consent before administering the preliminary breath test (PBT) to Ms. Schiller-Nichols’ client.  Under case law in Michigan, the officer must first obtain consent from the individual who is under 21 years of age before administering the preliminary breath test (pbt).
