Mike Nichols will speak to attorneys who are on the court appointed attorney roster for Ingham County. "I am happy to give back," said Nichols. "If at least one attorney gets one thing out of my presentation then I will have accomplished something, because that attorney will then be that much more capable of making a difference in the life of his/her client" he added. The presentation is scheduled for late January, 2009.

The December issue of the Ingham County Bar Associations BRIEFS newspaper features and article by Mike Nichols on attorney fees in good times and bad. The article is attached. "It was inspired when I had a conversation with a judge, who observed that it is heartbreaking to see attorneys who take money from families and generate work in a case only to generate fees," said Nichols.

A Nichols Law Firm client is the beneficiary of a successful result in a drunk driving case in which the blood aclohol content was allegedly .18. "We filed a motion to suppress those test results" said attorney Mike Nichols. Nichols added "the reason is because the arresting officer did not follow the rules for observing the subject for 15 minutes immediately prior to administering the test." Said Nichols: "I was so pleased for the client because she had a lot at stake because of her job." Ultimately, the prosecuting attorney agreed to a plea bargain that will result in the client having a conviction for a non-alcohol related offense on her record so it saved her the attorney fees and the stress of litigating the case to the final outcome.

Client relations was the topic of a lecture presented by Mike Nichols at the Ingham County Bar Association’s fist “luncheon lecture” for the 2008-2009 season. Mike Nichols taught attorneys some basic principles of client relations and reviewed the Michigan Rules of Professional Conduct with a humorous touch. A Nichols Law Firm client and her corporation and business partner will be able to operate their new business despite a lawsuit filed by their former employer that resulted in a restraining order. "It was all about showing up for the injunction hearing prepared to argue the facts and the law." The settlement allows the Nichols Law Firm's client to do most everything as part of her business that she had planned and set up. Nichols said, "we got our hands on the facts and prepared our written response and our arguments for the hearing in a very short time."

A client of The Nichols Law Firm will be able to enroll at Michigan State University despite a push from the City of East Lansing to ban him from campus. A state law allows judges to ban anyone from any public university or community college for a year if the person is convicted of an act related to a riot. "These cedarfest cases garnered such an aggressive response it was as if anyone who had any remote involvement in the events should be punished to the fullest extent of the law," said attorney Mike Nichols. "The problem was that absolutely everyone was forced to either go to trial or plead guilty and face the banishment" Nichols added.
However, a Judge ordered the client of The Nichols Law Firm to serve one year of probation with two weeks of jail to be served in staggered periods so that the young man can maintain his job. He is hoping to return to Michigan State University in January. He has been attending a community college in his hometown because of the legal costs incurred by his family. A client was charged with Operating While Intoxicated after his blood alcohol content was tested at a .09/.10. He had a prior OWI from 1999. Karen Phillips of the Nichols Law Firm, PLLC, filed a motion to suppress the DataMaster results since there was a lack of simulator logs that gave reason to question the accuracy of the test results. This aggressive litigation and negotiation by Ms. Phillips secured a Reckless Driving charge for the client and avoided an additional alcohol related driving offense on his Michigan Driving Record.

An MSU student received two misdemeanor charges for having an Open Alcohol Container and a third misdemeanor charge for Furnishing Alcohol to a Minor. Karen Phillips of the Nichols Law Firm, PLLC, got one of the Open Alcohol charges dismissed completely, the second reduced to a civil infraction and the Furnishing Alcohol to a Minor charge reduced to a civil infraction as well.
