DRUNK DRIVING CHARGE TO BE DISMISS: CARELESS DRIVING OFFERED TO NLF CLIENT AFTER RELENTLESS LITIGATION

An NLF client was allowed to accept a plea to careless driving in exchange for the dismissal of a drunk driving charge. "We worked our butts off because it was the right thing to do," said attorney Mike Nichols. The NLF client was indigent. The results of his datamaster test were .09 .11 .09. "Those results were too disparate to ignore. I am proud because we found a defense for this young man when he was ready to plead guilty," Nichols added. the case was a roller coaster ride, with the court denying a motion for payment of an expert witness at court expense and the circuit court affirming after an interlocutory appeal. Nichols said: "sometimes all you have is fortitude going for you ... and sometimes that's enough."
