JUDGE ORDERS PLEA AGREEMENT MODIFIED IN MURDER CASE AFTER FLAWS EXPOSED BY NICHOLS LAW FIRM

"The judge had no option but to give the client some relief ... it's just unfortunate that it had to happen the way that it did" said Mike Nichols.  The client pleaded guilty to second degree murder but the plea agreement that his attorney testified he communicated to the client was not the plea agreement that was placed on the record.  "We filed a motion to withdraw the client's plea and I was shocked by what I saw once I got the file from prior counsel and I was disappointed at the way prior counsel handled things in response to our motion."  The client wanted to have his day in court because he did not believe that he was guilty of the charge to which he pleaded guilty. The Nichols Law Firm worked with the Ingham County Prosecuting Attorney's office to diminish the client's prison exposure once the judge decided that the client could not withdraw his plea but that the agreement should be modified to be consistent with what the client believed were the terms of the plea agreement.
