Not Guilty Verdict in East Lansing DUI case

An East Lansing jury found an East Lansing man not guilty of Driving Under the Influence despite a blood alcohol level that was nearly 3 and a half times the legal limit and an accident.  “The moment I got the police officer to admit that he did not know what time the accident happened, the reasonable doubt became a possibility” said lead counsel Mike Nichols.  “I also knew that the officer had to admit that he did not know what time the accident happened because he admitted that at a Hearing about 6 weeks before the trial on a Motion to dismiss”.  The jury deliberated for about an hour and a half before deciding that the city just could not prove its case.  The argument turned on the fact that the city could not prove what the client’s blood alcohol level was at the time of the accident because of the lapse between the accident and the client’s arrest.  “Further, the .27 result on the datamaster did not make any sense compared to the officer’s testimony about his observations of the client’s ability to function”.  The client was a refugee from Afghanistan. Mike Nichols and Fred Bell tried the case.
