Drugged Driving or Drunk Driving Causing Death

Drugged or drunk driving is a crime that is specifically described in Michigan law at MCL 257.625. There are multiple ways that a prosecutor can pursue charges in the case of a death from an accident where the driver is believed to be under the influence of any alcohol, marijuana, other illicit controlled substances or an overdose of prescription medication. Drugged driving resulting in dealth or drunk driving causing death carries a 15 year penalty. Michigan law now requires that the prosecutor prove that you were driving while intoxicated and that your driving was the legal as well as the factual cause of the accident. It is therefore, critical to invest the resources that you can get together as soon as possible into an accident reconstruction to either review the government’s accident reconstruction or even produce one of your own.
