Wendy Schiller-Nichols obtained a dismissal of her client’s Drunk Driving charge. Ms. Schiller-Nichols’ client was charged with Impaired Driving. At the roadside, the client’s pbt was a .08; however, the Datamaster result was .06. The prosecutor’s policy is no offers on drunk driving cases and, therefore, there was no offer on this case. Ms. Schiller-Nichols convinced her client, who just wanted to plead guilty to the charge and “get it over,” to hold out and proceed to jury trial. Two days prior to jury selection, the prosecutor called Ms. Schiller-Nichols and advised that they are dismissing the charge. |
