An East Lansing District Judge dismissed a count of accessory after the fact in the MSU Fireworks case. The preliminary examination in the case concluded on Friday January 23, 2010. At the beginning of the final day of testimony, the prosecuting attorney moved to reduce the charges from felonies with 20 year maximum penalties to 15 year maximum penalties. “The prosecutor knew that she had not and could not prove damage and so she did the right thing,” said lead attorney Mike Nichols. The district judge ordered that the prosecutor could take the case to trial arguing accessory after the fact as an alternative count to the primary counts of conspiracy to use explosive devices and conspiracy to possess bombs. “We continue to make progress in building our defense.
