The Supreme Court of the United States granted a new trial last week to a Michigan man who says his lawyer gave him bad advice. "The Cooper case gives us another example of why practicing criminal defense is a unique area in which lawyers should not dabble," said Mike Nichols of East Lansing.  Nichols added, "in fact, there are sub-sets of criminal law in which lawyers who focus their practice are the most successful and most helpful to those who find themselves charged with certain crimes such as DUI or sexual misconduct."The lawyer told the Mr. Cooper that he should not accept an offered plea bargain because he could not be convicted of murder since he aimed his gun below the waist of the woman who was killed.

A good explanation of the case can be found at the blog, "the Oyez project."
