There is no doubt that the State of Michigan is cracking down on drunk driving or operating while intoxicated. That doesn’t mean, however, that if you are charged with operating while intoxicated or drunk driving that you have to throw your hands up and plead to whatever the Prosecutor is offering. Evidence may include videos from the police vehicle that captured the stop, videos from the booking, calibration logs of the Datamaster machine or breath machine that they blew into at the police station, the police report and any other evidence that may be available and/or applicable. There is more to a drunk driving case than the fact that you blew a .10, or whatever, in the Datamaster or breath machine.
