CRACK DOWN ON DRUNK DRIVING OR OWI BY THE STATE OF MICHIGAN

There is no doubt that the State of Michigan is cracking down on drunk driving or operating while intoxicated.  That doesn’t mean, however, that if you are charged with operating while intoxicated or drunk driving that you have to throw your hands up and plead to whatever the Prosecutor is offering.  Many of Ms. Schiller-Nichols’ clients come to her and their initial thought is that because they blew a .10 and are charged with operating while intoxicated, they do not have a choice and should just plead to the offer.  The misconception is that you cannot win a drunk driving case.  That is not true says Wendy Schiller-Nichols. 

It is very important for people charged with operating while intoxicated or drunk driving to review all of the evidence that the State of Michigan has against them before making any decision in any drunk driving case.  Evidence may include videos from the police vehicle that captured the stop, videos from the booking, calibration logs of the Datamaster machine or breath machine that they blew into at the police station, the police report and any other evidence that may be available and/or applicable.  There is more to a drunk driving case than the fact that you blew a .10, or whatever, in the Datamaster or breath machine.  It is important that individuals charged with drunk driving contact an attorney who has experience with drunk driving cases to determine their options.  Oftentimes, charges can be reduced to a non-alcohol related offense or even dismissed.
