     When you are charged with OWI-OUIL-OUID in Michigan, there are few lawyers who are committed to results like author-professor and trial attorney Mike Nichols. "I was thrilled to end the week recently with a phone call to a client to tell her that her OWI was getting dismissed," said Nichols. Nichols, who dedicates his practice to defending those charged with drunk and drugged driving, added "we won a critical motion based on some last minute discovery. We reviewed the data and realized that the officer did not properly utilize the implied consent act to collect her blood: the judge agreed and excluded the blood estimate from the trial."

     "I was so impressed with your team approach and how you kept digging to find hope," the client told Nichols. The argument was based on longstanding caselaw including a United States Supreme Court case called "Sheckloth v Bustamonte" and Michigan cases called "People v Hyde" and "People v Borchard-Ruhland." In essence, the officer reversed the meaning of the implied consent rights and gave the impression to the woman that she would have to give her blood regardless of whether she consented to the blood draw. Nichols said "this was key - she thought her options were give the blood and face a 1 year suspension of her driving privileges and 6 points on her driving record, or give the blood by consent and not have to suffer a penalty."
