Michigan Drunk Driving Attorney Mike Nichols of Meridian Township says "breathal-eyes" and "novelty pbt" Devices are Just that: Novelties

You go to a Super Bowl Party; you think about that next drink - will it be a soft drink or a whiskey and coke? Mike Nichols says there is no substitute for the science: "if you blow in a portable pbt or use those "breathal-eyes" devices, it will not give you a true representation of your bodily alcohol content." Nichols adds: "I am amazed when I hear people talk about how "the eyes don't lie. The horizontal gaze nystagmus test is one of the most overused, misunderstood concepts in our justice system today."

Nichols says that there is no substitute for common sense and good judgment: "2 drinks will not get you near the legal limit. Once you start that 3rd drink, I would not be worried about being over the legal limit so long as you are not slamming, my concern would be that you are going to be falsely reported by a breath or blood test if you are pulled over on the way home."

Nichols says that if you are pulled over after watching the Super Bowl and spend the night in jail, it is wise to seek out qualified legal help: "you need someone familiar with the science as well as the law and who also has access to experts on the investigative tactics like the gaze nystagmus trick and the chemical testing. For example, we did some digging and found some secrets at the Meridian Township Police Department about their breath test device called the 'datamaster DMT' that I bet they don't want the public to know about."
