EXCELLENT RESULT IN A MICHIGAN-OWI/DUI-2d OFFENSE: NO JAIL

A Michigan judge imposed a sentence of no jail time for a citizen charged in southwest Michigan with OWI 2d. “This should be a lesson for anyone who is concerned that you will be punished for going to trial,” said attorney Mike Nichols, author of the Michigan OWI Handbook for West Publishing. The client was convicted in St. Joseph County of OWI and speeding. The arresting officer testified that his patrol car reached speeds of up to 100 miles per hour but he gained little ground on the car driven by the client. “That mattered less to the judge at sentencing and what was more important was everything that the client did between the day of his arrest and the day that he was sentenced. The judge knew that we went to trial because that was the only way that we could even have a hope of saving the client’s license,” Nichols added.
