A Michigan judge is considering a challenge to the testing and reporting procedures in the blood lab in Lansing, Michigan in a Michigan felony DUI/OWI case. The issue is the reliability of the procedures used in calibrating the instruments and testing the evidence in the Michigan State Police Blood Lab in Lansing, Michigan. "It seems complex on many levels, but when you break it down it's just a matter of basic science and basic statistics," said Mike Nichols. An expert witness, Dr. Karl Ebner testified on June 23, 2010 that the lab in Lansing has not demonstrated scientifically valid methods for the way it calibrates its instruments, the way it measures the evidence and the way it reports and cross-checks its results. The hearing is expected to resume in July, 2010. |
