Institute for Continuing Legal Education 2016 Drunk, Drugged and Distracted Driving Update - Mike Nichols Featured

By Michael Nichols
Categories: Michael J. Nichols

Mike Nichols is preparing to serve as one of the lead presenters for the 2016 "Drunk, Drugged and Distracted Driving Update" for the Institute for Continuing Legal Education (ICLE). The update will include a number of topics such as new laws and court opinions as well as developments in the evidence gathering techniques by police officers.

Nichols says "one of the most significant areas that needs to be discussed is the pilot project for Drug Recognition Evaluators (DRE's) and Roadside Saliva Testing (RST)." The pilot project for the 2 new areas of evidence-gathering for law enforcement is implemented by virtue of revisions to MCL 257.62, adding sections to the law that give the Michigan State Police wide latitude to pick which counties to use, which vendors to use and which officers get the training. Nichols adds, "the only real requirement in the legislation is that only counties where trained DRE officers are employed will qualify for this pilot project."

This ICLE update features the 2nd time that Nichols is a featured panelist. He says "I am honored to be asked to help educate lawyers, judges and prosecutors on drunk driving law and practice. The last time I did this was 2011 and one of the collateral benefits of that panel was the creation of the Michigan Association of OWI Attorneys, which is going strong 5 years later."
