Nichols Lawyers File a Brief on High Profile Public Official Misconduct Case

A crime was simply not committed in a high profile misconduct in office case in Northern Michigan’s Iosco County argues the Nichols Law Firm team in a brief filed with 81st District Court on September 20, 2016. Mike Nichols leads the team representing Deputy Treasurer Cathy Anderson. Nichols says “Ms. Anderson is charged with a very specific crime of embezzlement by a public official or agent or servant of the official,” he says. The crime is found at MCL 750.174. Nichols adds “the prosecutor has to show, with first hand testimony and evidence that the person charged intentionally and unlawfully took public money and used them for an illegal means and the preliminary examination did not produce that so the case should be dismissed.” The briefs from both sides as well as the pdf for the transcript of the preliminary examination can be found here:

The preliminary examination was held on August 23rd, 2016. Nichols says “we believe that the prosecutor charged this case with an insufficient investigation and a lack of evidence of criminal activity – why she made a rush to file a charge is speculative but we know she is running for judge in that circuit.” The briefs have been submitted and a decision by District Judge Allen Yenior is expected soon.
