Drunk Driving Charges in Lansing and East Lansing: Is There a Secret to Beating the Case?

By Michael Nichols

If you are unfortunate enough to be arrested in East Lansing, Lansing or Meridian Township for Operating While Intoxicated (a/k/a drunk driving or OWI) you are probably as scared as you have ever been about what may happen to you. Super Drunk, OWI and OWVI are all punishable under MCL 257.625 and the conviction may not be set aside (expunged) under current Michigan law.

Fortunately, one of Michigan’s top drunk driving attorneys calls East Lansing/Merdian Township his home. Mike Nichols has lived in the greater Lansing area for over 30 years and he has practiced DUI/Criminal Law for the past 19-plus years as of 2018. He says that the key is fortitude: “of all my cases, the situations in which the client has said: ‘this is my objective and I am not pleading unless I realize this objective’ are the situations in which the right result comes from either a jury verdict or a really good plea agreement.”

Nichols recently tried a blood alcohol case with a claimed blood alcohol content of .30 to a not guilty verdict in the 55th District Court in Mason in Ingham County. A case result should not create an expectation of a specific outcome, but Nichols say it is all about hard work. “The client told us that she could not and would not plea to a misdemeanor,” he says. Nichols adds: “the client also seemed very relaxed during the late preparation and the proceedings.”

Nichols also obtained a not guilty verdict on May 22nd, 2018 in Mason County (Ludington) on a charge of Home Invasion 1st degree and assault and battery. Home invasion is punishable by up to 20 years in prison. The jury returned a verdict of not guilty on all charges, despite phone calls in which the prosecutor claims the client expressed he was going to go to the home of the boyfriend of his mother and “kick his ass.” Nichols says: “there is and was no substitute for hard work and preparation. This case is a classic example of why. Some say we are a premier OWI defense firm. I say we are simply a ‘premier law firm.’”
