There are often no winners in a divorce - but every now and then we make it right as best we can for parents in a seemingly impossible position with their soon-to-be "ex."
In a recent custody case, Jackee Moss’ client was a father that was being denied parenting with his infant daughter. This was weighing heavy on the client because up until recently, he had been an everyday fixture in his daughter’s life. He desperately wanted and needed help when he contacted The Nichols Law Firm.
Due to the circumstances of the case, Attorney Moss was able to get his client temporary custody through an emergency court order by utilizing MCR 3.207, until the court could further assess the situation.
An Ex-parte motion was filed on behalf of the client emphasizing the child’s risk of irreparable harm without immediate court intervention. The motion also highlighted, why the father was the best place for the child by the best interest of the child factors as provided in MCL 722.27.
Upon reading the motion drafted by Attorney Moss, the Judge in the case signed an Ex-parte order granting his client temporary custody. Needless to say, the father was elated to be reunited with his daughter. Many times, it’s tough to consider a situation as a win in family law, because there are no winners but we were glad to play a role in reuniting father and child.
