CLIENT KEEPS HIS DRIVERS LICENSE AND HIS JOB AFTER OWI 2ND CHARGE

A citizen charged with a second OWI caught a break with the help of criminal defense attorney Wendy M. Schiller-Nichols. After an extensive conversation with the District Court Judge, Ms. Schiller-Nichols was able to obtain a 1-year deferred plea and sentencing program for her client. As part of the penalty for a second OWI charge within 7 years, driving privileges are revoked for one year. Due to a career that required the client to drive, the District Court Judge agreed to hold off on the plea and sentencing for a year.  This allowed the time to exceed the 7 years so that the client did not lose his license for the mandatory 1 year.  As a result, the client got a restricted license for 90 days.  During that deferral year, the client was required to attend counseling, attend the Victim’s Impact Panel, and a Highway Safety Program. At the time of his sentencing, which was one year later, he was only required to pay fines and costs. With the help of Ms. Schiller-Nichols expertise, this citizen was able to keep not only his job but also his peace of mind.
