PROTECT YOUR FUTURE: MAKE SURE ANY COURT SUBSTANCE ABUSE ASSESSMENT IS ACCURRATE

By Michael Nichols

DUI-OWI-OUIL expert Mike Nichols says that court ordered substance abuse assessments can be inaccurate and that can ruin your life. "We recently had had a probation officer misinterpret the value the client input into the hand scored substance abuse assessment," said OWI defense attorney Mike Nichols. "The error had the client drinking regularly at age 2 and incurring 4 prior assault convictions. Further, it showed him using tranquilizers 2 weeks before sentencing," Nichols added.
Fortunately for the client, Mr. Nichols demanded the assessment be corrected under a court rule regarding presentence reports. The court agreed and the sentencing was adjourned. "Not only would the erroneous assessment have led to stricter treatment terms than what this client needed, but the data would have been represented inaccurately to the regulatory agency that would have demanded to see the assessment because of the client's profession," said Nichols.
